do you mean when someone attacks you, or the other way around?

The Kraken, which is found primarily in Scandinavian myth, was a huge sea creature. It was said to lie at the bottom of the sea for a long time and then it would rest at the surface....Like the Midgard serpent in the Norse myths, the Kraken was supposed to rise to the surface at the end of the world.

i think that there are two types, one where the attackers spies are foiled! and then another when they actually beat the defenders spies (or, in another word, loose a battle with the spies), yet, do not succeed in taking land, murder...etc...
if the attackers spies actually penetrate and loose a battle with the attackies spies, then i can see how that is a failed defense.
but if the attackers are foiled, then i cannot see how then the defender should loose that one. (or, as artus put it, count as a failed defence)
in essence, it must be the code
but i do think if the spies do penetrate and yet, still fail to gain anything from thier attack, that should count as a failed defence against the defender.

Depending where the problem is, it may/not need to be fixed. Not a problem here, but if its being abused at ME it should get looked at.

the only thing i can think of that would show that is if you are attacked by mages for land and the mages penetrate your defenses but fail to get the land because ur mages stop them then it will show as a failed attack and failed defense.
ie the msg the attacker would get is ur spies successful penetrate the defense however the opponents spies prevent you from taking anything.
